These Terms of Service (“Terms”) are a legal agreement between you (“you,” “Member,” or “User”) and AIPU Unlimited (“AIPU Unlimited,” “we,” “us,” or “our”) for access to the website https://aipuunlimited.com, our web application, and related services (collectively, the “Service”).

By creating an account, subscribing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is not available where prohibited by law.

2. The Service

AIPU Unlimited provides a unified creative workspace that connects to third-party AI models and tools for video, image, audio, writing, agents, and code generation. We license access through underlying providers; availability of specific models may change without notice.

We are not affiliated with Meta Platforms, Inc., Facebook, Instagram, OpenAI, Anthropic, Google, or any model provider. Third-party trademarks belong to their respective owners.

3. Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate registration information at aipuunlimited.com/account.html.
• You may not share accounts, resell access, or use the Service for unauthorized automated scraping except as permitted by API terms we publish.

4. Subscriptions & Billing

Paid plans (including promotional “founder” pricing displayed on the Site) are billed in advance on a recurring basis unless stated otherwise. Prices are shown in U.S. dollars unless noted.

• Founder rate lock: If you subscribe at a promotional founder rate while offered, that rate applies to your continuous subscription as described at checkout and in plan-specific disclosures.
• Payment: You authorize us and our payment processor to charge your payment method on each billing cycle.
• Taxes: You are responsible for applicable taxes.

5. Refunds & Cancellation

• Money-back guarantee: If a guarantee period is stated at checkout (e.g., 7 or 30 days), you may request a refund within that period by contacting support with your account email.
• Cancellation: You may cancel anytime from your account billing settings or by contacting support. Cancellation stops future charges; access continues through the end of the paid period unless otherwise stated.
• Chargebacks: Filing an improper chargeback may result in account termination.

Promotional bonuses (e.g., additional cash-back offers) may have separate conditions disclosed on the pricing page.

6. Commercial License

Subject to these Terms and underlying model providers’ policies, you receive a license to use content you generate through the Service for personal and commercial purposes. You are responsible for ensuring your use complies with third-party rights, advertising laws, and platform rules (including Facebook/Instagram ad policies).

7. Acceptable Use

You agree not to:

• Violate any law or infringe intellectual property, privacy, or publicity rights;
• Generate or distribute illegal content, non-consensual intimate imagery, malware, or deceptive deepfakes intended to harm;
• Harass, threaten, or discriminate against others;
• Attempt to bypass security, rate limits, or usage controls;
• Misrepresent AI-generated content as human-created where disclosure is required by law or platform policy.

We may suspend or terminate accounts for violations.

8. User Content

You retain ownership of content you submit and generate, subject to licenses you grant us to host, process, and display it solely to operate the Service. See the Privacy Policy for data practices.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE, INCOMPLETE, OR OFFENSIVE. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING OUTPUTS BEFORE USE.

Results described in marketing materials (income, savings, timelines) are examples only and are not guarantees.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIPU UNLIMITED AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

11. Indemnification

You will defend and indemnify AIPU Unlimited against claims arising from your use of the Service, your content, or your violation of these Terms.

12. Dispute Resolution

Before filing a claim, contact us at legal@aipuunlimited.com to attempt informal resolution. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.

13. Changes

We may modify these Terms by posting an updated version on aipuunlimited.com. Continued use after the effective date constitutes acceptance. Material changes to paid subscriptions will be notified in advance where required.
